The role of president and director in the association of owners in Spain.

The Owners' Association in Spain is governed by the General Assembly, the President and, where appropriate, the Vice-President, the Secretary and the Administrator. The president is elected from among the owners of the association by voting or by other means, such as drawing lots.

It is a mandatory position although the law allows that if the owner can justify his cause, the court may be asked to be released from the position. This request must be submitted within the period of one month from the appointment of the position. The judge will decide on this request, and will also appoint the owner to replace the president in his position.

The President has the task of defending the Spanish Owners Association in all matters related to it, both in court and out of court.

He may also perform functions of secretary and administrator, except if the articles of association or the Board of Directors stipulate that these functions are performed in a separate manner from the chairmanship.

The Director's position may be performed by any owner, as well as any person with sufficient professional and legally recognized qualifications to perform these functions.

The functions of the director of the association in Spain are as follows:

1.- Supervise the good governance of the urbanization, its installations and services, making appropriate remarks and warnings to the owners.

2.- Prepare the plan for the anticipated costs sufficiently in advance and submit it to the Assembly, and propose the necessary measures to be able to comply with it.

3.- Taking care of the maintenance of the urbanization, carrying out the repairs and taking the urgent measures to that end. He will immediately report this to the President or, as the case may be, to the owners.

4.- Carry out the agreements that were drawn up in connection with work and the execution of the payments or the receipt of amounts.

5.- Where appropriate, act as secretary at the Meeting, and make the association's documentation available to the owners.

6.- All other powers granted to him/her by the Board of Directors.

The appointments of president and administrator are made for a period of 1 year, unless otherwise stated in the articles of association.
